In order to qualify for a California misdemeanor expungement under California Penal Code Section 1203.4, you must meet the following criteria:
- You have completed your probation
- You do not have any pending charges against you or are serving any other sentence when you file for the expungement
- You have paid all of your court-ordered fines and fees
Additionally, you qualify for a California misdemeanor expungement as long as your misdemeanor case is not in one of the prohibited categories itemized in the California Penal Code. Most of these categories are generally felonies, so there is a very good chance that your case qualifies for an expungement. Additionally, if no probation time is served, there is an expanded list of disqualifying offenses (generally, these disqualifying offenses are very uncommon).
