HOW DO I KNOW IF I QUALIFY FOR A CALIFORNIA PROP 47?

You qualify for a California prop 47 felony reduction to a misdemeanor as long as your felony is on the Prop 47 list and is not in one of the prohibited categories itemized in the California Penal Code. This is true even if:
- You went to prison, or
- Received a suspended prison sentence
Please note that a Prop 47 reduction is available even if you are currently serving a prison sentence and this allows you to be re-sentenced and released from prison. If you already completed your sentence, then it is referred to as a Penal Code 1170.18 Reduction to a Misdemeanor. ELIGIBLE OFFENSES
The following offenses are eligible for a California Prop 47 Reduction to a Misdemeanor:
Covered Theft Offenses
- Commercial Burglary that meets new definition for shoplifting (CA Penal Code 459)
- Property theft when the value of the stolen property is $950 or less (CA Penal Code sections 490.2 and 459.5)
- Receiving stolen property $950 or less (CA Penal Code section 496(a))
- Forgery of a check, money order, and so on $950 or less, unless you were also convicted of identity theft under CA Penal Code section 530.5 (CA Penal Code section 473(b))
- Petty theft with a prior, unless you received a prior conviction for a theft offense or elder abuse, served a term for the required, and/or are required to register as a sex offender (CA Penal Code section 666)
- Grand theft if the value of the stolen property does not exceed $950.
- Passing bad checks $950 or less, unless you have three or more priors for CA Penal Code sections 470, 473, 475, or 476 (CA Penal Code 476(a)(b))
Covered Drug Offenses
- Possession of narcotic controlled substances, such as cocaine, heroin, morphine, or other opiates (CA Health and Safety Code section 11350)
- Possession of restricted dangerous drugs which could include drugs such as methamphetamines, or hallucinogenics such as psilocybin mushrooms (CA Health and Safety Code section 11377)
- Possession of concentrated cannabis (hashish). (CA Health and Safety Code section 11357(a))
IF YOU ARE NOT ELIGIBLE FOR A PROP 47 YOU MAY BE ELIGIBLE FOR A STANDARD REDUCTION
Please note that you are not eligible for Proposition 47 if you have a prior conviction for any of the following:
- A prior conviction for any serious or violent felony punishable by death or life in prison
- A prior conviction for possession of a weapon of mass destruction, and/or
- A prior conviction for assault on a peace officer or a firefighter with a machine gun.
- Homicide (Penal Code §§ 187 to 191.5)
- Attempted homicide
- Solicitation to commit murder
- A prior conviction for a sexually violent offense listed in Welfare and Institution Code section 6600(b)
However, in addition to Prop 47 there is another statue that provides for reducing a felony to a misdemeanor. In fact, all offenses covered under Proposition 47 are also covered under California Penal Code 17(b) except for that mentioned under the Health and Safety Code 11350. If you are eligible for a true reduction under Penal Code 17(b), then it is typically a better option. We can help you determine which type of reduction best suits you.
