    WHY WAS MY GUN PURCHASE DENIED?

    Several common reasons for gun purchase denials


    Before you can restore your firearm rights or appeal a denial, you have to figure out what is causing the denial. This is not always as simple as it seems and sometimes there are multiple problems that all must be resolved.

    Here are several of the most common reasons for gun purchase denials: 

    Reason 1: Inaccurate Records


    One very common reason for a gun purchase denial is incorrect or inaccurate records.  Gun purchases are always denied based upon state or federal level records. You will not be denied a firearm purchase because of an incorrect court or police record if the state and federal records are accurate.  However, incorrect state or police records generally mean that the state or federal records are also incorrect.

    Furthermore, even if federal records, such as the FBI report and FBI/ATF NICS database, are incorrect, you will not necessarily be denied a gun purchase as long as your state record is correct.  FBI records are generally only the cause of denials for out-of-state convictions. The state record of your criminal history is known as the Department of Justice Criminal History Record, also called a DOJ report or a livescan.

    Reason 2: Felony Convictions & Domestic Violence Convictions


    A felony conviction or a misdemeanor domestic violence conviction results in a California and federal gun ban.  Domestic violence convictions include any offense which is committed against a girlfriend/boyfriend, spouse, or ex or a child of yours or of a significant other which involves touching or the threat of touching.

    There are also other California offenses which can cause a 10 year ban.  Certain juvenile offenses can trigger a ban until you reach the age of 30.

    Reason 3: Other Gun Bans


    You can also be denied for being a drug addict, a fugitive from justice, for having been committed to an institution for mental health treatment, or for being dishonorably discharged from the military.  Currently, obtaining a medical marijuana card or legally purchasing medical marijuana does not prohibit you from purchasing a firearm in California. This is not the case throughout the United States. It is possible that the federal government could change this in the future and institute a 1-year drug addict ban after you obtain a marijuana card.  Lifeback Legal closely monitors changes in the law, as we understand this is a major concern for many people.

    It is a common misconception that an expungement will restore your gun rights. Rather, an expungement in California has zero effects on your gun rights. However, certain types of offenses are eligible for relief similar to an expungement which can restore your gun rights.  The best mechanism for gun rights restoration is a court-ordered reduction of an offense from a felony to a misdemeanor. This will not work for certain bans which apply to misdemeanor convictions.

    Pardons and Certificates of Rehabilitation


    We only recommend that you attempt a California Pardon or Certificate of Rehabilitation for the purpose of gun rights restoration if you are not eligible for reduction. While our current Governor Brown has granted numerous pardons, most Governors do not. Even if you successfully obtain a Certificate of Rehabilitation, the Governor must still grant the pardon to get your gun rights back.  Do keep in mind, the Governor can grant a pardon that specifically does not restore your gun rights if he or she chooses.

    Incorrect Court Records


    If court records are incorrect, you have to request the clerk update the records and the Department of Justice records.  If the Clerk refuses, you can sue to force an update and challenge the record directly with the Department of Justice.

    Unreported Dispositions


    An unreported disposition is when a police department or court never report that your case was closed.  Having what looks like an open case can cause the Department of Justice to believe that you may have a conviction which prohibits your firearm rights.  This is a common problem.

    A police department may forget to report that your case was a detention only or that the case was dropped.  If this occurs, you have to complete an administrative review process with the department in question to change the disposition.  If they refuse, you can sue the department to force an update. You can also challenge the incorrect record directly with the Department of Justice as a last resort.  

    Incorrect DOJ Records


    If DOJ records are incorrect, and it is verified that the submitting agencies have all submitted the information required for the records to be corrected, you can complete an administrative review process with the DOJ to request an update.  If they refuse, you can sue to force an update.

    Sometimes, even if the submitting agency record is not corrected, you can still submit a challenge directly to the Department of Justice.  We do not recommend going to the Department of Justice as the first step because they can be very slow at processing challenge requests.
