Known formally as a California Criminal History Summary Report or informally as a Department of Justice (DOJ) report, DOJ report, or Livescan, this document is the main source of information regarding a person’s criminal record within the state of California.  This is because courts, police departments, and county sheriff agencies report isolated arrests, case outcomes or “dispositions,” and various forms of post-conviction relief such as an expungement or 1203.4 dismissal to the Department of Justice in Sacramento. The DOJ then adds this information to your report.

This report is not always accurate, however. Sometimes a police or sheriff departments fails to report that an arrest was merely for detention only, suggesting you may have been convicted or charged for a crime when you weren’t. Other times, a court clerk may fail to report the outcome on your case accurately, implying you were convicted of a felony rather than a misdemeanor. And so on. These mistakes can have disastrous consequences for your employment clearance, license application, and can lead to loss of civil rights or gun rights.

How Do We Determine if Your DOJ Report is Inaccurate?

  1. Direct Agency Updates.  A direct agency update is when you contact the agency in charge of reporting the correct information in order to obtain the desired update.  Some agencies are more amenable to this than others.
  2. Direct DOJ Report Updates.  This process often fails if the DOJ is unable to verify with the agency and if the DOJ does not have scanned records of the case.  You never know what the DOJ has on file, so submitting a DOJ report update is a good step to take.
  3. Lawsuit.  If all else fails, you can take the case in front of a court and even ask for attorneys fees for your trouble.  We know the process and are willing to fight for our clients even if the agency and DOJ deny our requests.
