WHAT IS A CALIFORNIA FELONY EXPUNGEMENT?

Simply put, a way to get your life back.

California Felony Expungement

Get your life back today.

After your case is expunged, you will be able to legally and confidently state “no” when asked on employment applications if you’ve ever been convicted of a crime.

A California felony expungement is a legal procedure that sets-aside your guilty or no contest plea and dismisses your conviction. The law is meant to reward those who have been rehabilitated and who want to get their life back.

This procedure is legally known as a 1203.4 Dismissal. This is because Section 1203.4 of the California Penal Code allows individuals who have completed their sentence for a felony offense to petition to have their case dismissed. If the petition is granted, the court will permit the individual to withdraw their plea of no contest or guilty. In addition, if the individual was convicted, the court will set aside the guilty verdict and dismiss the accusations against the individual. The result is that the offense will not appear on most employment background checks and you will be legally entitled to answer “no” when asked on an employment application if you’ve ever been convicted of a crime.

WHAT CAN I EXPECT ONCE I EXPUNGE MY CALIFORNIA FELONY?

    Your Life Back

Once your past felony criminal record is expunged, you can say truthfully that you were not convicted. However, there are three narrow circumstances when your conviction must be disclosed:

    1. If asked on application or questionnaire for public office
    2. When getting a license from a local or state agency, and
    3. When contracting with the California State Lottery Commission

In addition, your conviction may still be considered by the DMV in revoking or suspending your driver’s license. If your felony is expunged, you will still not be able to own or possess a gun and could still be charged with possessing a firearm as a felon. If restoring your gun rights is important to you than you will also want to see if you are eligible for a California felony reduction to a misdemeanor.
